Hecate App Terms of Use

Welcome to Hecate! These Terms of Use ("Terms") govern your access to and use of the Hecate mobile application (the "App"), provided by Mykyta Karpyshyn ("we," "us," or "our"), an individual developer. By enabling the "I accept Terms of Use and Privacy Policy" switch and continuing to use the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

1. Eligibility and Account Creation

To use the Hecate App, you must be at least 18 years old. By using the App, you represent and warrant that you meet this age requirement.

Your account is created on an anonymous, on-the-fly basis and is primarily linked to your device. During registration, you will provide your Name, Birthdate, and Gender for personalization of your readings. No password is required for your current account setup. Please note that your account data is associated with your current device, and there is no current functionality to sign in from another device to access the same data. While future features may include social login options to preserve data across devices, this is not currently available.

2. Use of the App

2.1. Intended Purpose

The Hecate App provides Tarot Card readings generated by Artificial Intelligence (AI). You acknowledge and agree that **all readings provided by the App are for entertainment purposes only**. They are not intended to be, and should not be considered, a substitute for professional advice of any kind, including but not limited to, medical, psychological, legal, financial, or personal advice. We bear no responsibility for the text or interpretations provided by the AI.

2.2. Your Input

When creating a new Tarot Spread, you will provide a "question to cards." This input, combined with the selected Tarot cards in the spread, is used by our AI (Vertex AI/Gemini AI) to generate your personalized reading.

2.3. Prohibited Uses

You agree not to use the App for any unlawful purpose or in any way that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App. This includes, but is not limited to, attempting to hack, damage the software, or engaging in any personal threats towards us or other users.

3. Intellectual Property

The Hecate App, its code, design, user interface, functionality, and the custom and well-known Tarot spreads integrated into the App are the exclusive property of Mykyta Karpyshyn. All intellectual property rights, including copyrights and trademarks, belong solely to us.

The Tarot readings generated for you by the AI within the App are intended for your personal, non-commercial use. You may use, share, and save these readings for your own enjoyment and reflection. However, you may not reproduce, distribute, or exploit the AI-generated content for commercial purposes without our express written permission.

4. Disclaimers and Limitation of Liability

4.1. "As Is" Basis

The Hecate App is provided to you on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not guarantee that the App will be uninterrupted, secure, or error-free.

4.2. Accuracy of Readings

We make no guarantees regarding the quality, accuracy, reliability, or predictive nature of the Tarot readings provided by the App's AI. The readings are generated algorithmically and are for entertainment and personal reflection only.

4.3. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Mykyta Karpyshyn, nor its employees or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

5. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Reasons for termination initiated by us may include, but are not limited to, attempts of hacking, actions causing damage to the software, or making personal threats.

Upon termination by us, your right to use the App will immediately cease. If we terminate your access, all of your associated data will be deleted from our systems as outlined in our Privacy Policy.

You may stop using the App at any time. You can delete your account and associated data directly within the App's Profile screen, as explained in our Privacy Policy.

6. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. We aim to resolve any disputes informally and efficiently.

Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination or invalidity thereof, shall first be attempted to be resolved through good faith negotiation. If a resolution cannot be reached through negotiation within a reasonable period, then the dispute shall be subject to the exclusive jurisdiction of the courts located in Poland, or, if applicable laws provide specific consumer rights for alternative dispute resolution, such alternative methods may be pursued.

7. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes by publishing the updated Terms on our website. You are advised to review these Terms periodically for any changes. Changes to these Terms are effective when they are published on the website. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
